Background
The concept of an open government is the direct emanation from the right to know which seems to be implicit in the right of free speech and expression guaranteed under Article 19(1) (a). RTI Act was enacted to consolidate the fundamental right of free speech.
Disclosure of Information in regard to the functioning of Government must be the RULE and secrecy an EXCEPTION justified where the strictest requirement of public interests so demands.
Informed citizenry and transparency of information and answerability in the working of public authority are vital to the functioning of democracy and also to contain corruption. Governments and their instrumentalities are accountable to the governed.
It is necessary to harmonize these conflicting interests while preserving the primacy of the democratic ideal. It is thought necessary to provide information to citizens who desire to have it. Hence the enactment by Parliament.
